International Traffic in Arms Regulations

Some jurisdictions restrict the export, import or sale of these goods. For example, certain weapons are considered “defense items” and are regulated by the US State Department under the International Traffic in Arms Regulations (hereinafter referred to as “ITAR”). For all goods subject to ITAR, a license, license exemption, or other approval is required from the US Department of State to “export” (22 CFR § 120.1 and subsequent provisions define export activities, including to or within the United States “Foreigners” or “Americans” at APO/DPO/FPO addresses outside the United States sell or transmit “technical data”). Violation of the EAR may result in the following penalties: a civil penalty of up to $250,000 for each violation or a penalty of twice the amount of the offending transaction, a criminal penalty of up to $1,000,000 fine for each violation, and 20 years of imprisonment, and/or deprivation of export authority.
